Review System Terms
These terms apply to the post-job customer feedback and review service (“the Service”) provided by Luke547, a trade name of Livingstone Rentals LLC (Washington), to you (“the Client”). By paying the invoice or using the Service, you agree to them.
1. What the Service is
Luke547 provides and operates a system that:
- lets your managers mark a job complete and capture photos from a phone
- prepares a message to the customer, which the manager sends from his own phone at close-out
- gives the customer one question about the work, with the answer recorded automatically
- directs customers to your Google review profile
- alerts you when a customer reports a poor experience
- records answers, photos and review link activity in a spreadsheet you can access
The Service is configured specifically for your business during setup. Changes to scope, such as additional brands, locations, or trades, are agreed separately.
2. Fees and payment
- Setup fee: a one-time charge, billed before configuration begins.
- Monthly fee: billed in advance, on the same date each month, to the payment method on file.
Fees are in US dollars and exclude any applicable taxes. Prices may change with 30 days’ written notice; any change applies from your next billing date.
3. Term, cancellation and refunds
The Service is month to month. There is no minimum term and no notice period.
You may cancel at any time. Cancellation takes effect at the end of the current billing period, and the Service continues until then. Partial months are not refunded.
The setup fee is non-refundable once configuration has begun.
Luke547 may suspend or terminate the Service for non-payment, or for use that breaches section 6, with notice.
4. What you are responsible for
- Providing accurate job and customer information
- Providing and maintaining manager contact details
- Ensuring you have a lawful basis to contact your customers about work you performed for them
- Responding to customers who report a poor experience
Messages to your customers are sent from your managers’ own mobile devices, as person-to-person messages. You are responsible for your team’s conduct in those messages and for compliance with applicable messaging law.
5. Your data
All customer information, job records, photos and feedback collected through the Service belong to you.
Luke547 accesses this data only to operate, support and improve the Service for you. How that data is handled, and the service providers involved, is set out in the Privacy Policy, which is the only policy governing data on this site.
On termination, the spreadsheet and its contents remain yours. Luke547 will remove its access on request, and will delete any copies held outside your own accounts.
6. Review integrity
The Service does not screen which customers are invited to leave a public review. Every customer receives the same review link regardless of their answer.
This is deliberate. Selectively soliciting reviews only from satisfied customers, known as review gating, breaches Google’s review policies and can result in reviews being removed or a business profile being suspended.
You agree not to ask Luke547 to configure the Service to gate reviews, to offer customers anything of value in exchange for a review, or to submit reviews that do not reflect a genuine customer experience. Luke547 may decline any such request and may terminate the Service if it continues.
7. No guarantee of results
Luke547 does not guarantee any particular number of reviews, star rating, search ranking, or business outcome. Results depend on your job volume, your customers, the quality of your work, and factors outside anyone’s control, including Google’s own policies and systems.
8. Availability
Luke547 will make reasonable efforts to keep the Service running and to resolve faults promptly, but does not guarantee uninterrupted availability. The Service depends on third-party platforms, and interruptions to those platforms are outside Luke547’s control.
9. Limitation of liability
To the fullest extent permitted by law, Luke547’s total liability arising out of or relating to the Service is limited to the total fees you paid in the three months before the event giving rise to the claim.
Luke547 is not liable for indirect, incidental or consequential losses, including lost profits, lost business, or reputational harm.
10. Confidentiality
Each party will keep the other’s non-public business information confidential and use it only in connection with the Service.
11. Testimonial and case study, where agreed
Where you have received a discount in exchange for a testimonial, you agree to provide a short written or recorded statement about your experience after a reasonable period of use, and to permit Luke547 to reference your business name, logo, and results in its marketing materials.
You may withdraw that permission for future use at any time in writing. Materials already published need not be withdrawn.
12. Changes to these terms
Luke547 may update these terms with 30 days’ notice. Continuing to use the Service after that period means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the State of Washington, USA.
