Terms of Service

These terms govern your use of the services provided by Livingstone Rentals LLC, doing business as Luke547. By purchasing or using the service, you agree to them.

The service

We configure and operate an AI phone receptionist for your business. It answers calls, asks qualifying questions, books appointments onto a calendar you provide, and alerts you when a caller describes an emergency. Every call is recorded and transcribed.

We build the configuration around the information you give us during onboarding. We may adjust it over time to improve how it performs.

Eligibility and age

You must be 18 years of age or older to use this service. By purchasing or using it, you confirm that you are at least 18 and that you are authorised to enter into these terms on behalf of the business you represent. We do not knowingly provide the service to anyone under 18, and we will close an account if we learn that the person using it is under age.

Fees and billing

• A one-time setup fee is charged when you sign up. It covers configuration and launch.
• The monthly fee begins when your receptionist goes live, not at checkout.
• Monthly fees are billed in advance and renew automatically until cancelled.
• Fees are quoted and charged in US dollars.

Fair use

Plans described as including unlimited calls are subject to fair use, currently set at 1,500 call minutes per month. Almost no business reaches this. If your usage exceeds it for two consecutive months we will contact you to discuss the plan. We will not issue a surprise bill, and we will not stop answering your calls without talking to you first.

Cancellation and refunds

You may cancel at any time. Cancellation takes effect at the end of the current billing month and there is no further charge. Monthly fees already paid are not refunded on a pro-rata basis.

The setup fee is refundable only if we are unable to deliver a working configuration.

What you are responsible for

• Forwarding or routing your phone line to the number we provide
• Giving us accurate information about your business, hours, and service area
• Keeping a calendar available and checking the appointments that are booked into it
• Responding to emergency alerts we send you
• Complying with the law that applies to your business, including call recording rules in your state

What we do not promise

We do not guarantee a particular number of leads, appointments, or jobs. The service depends on third-party platforms and telephone networks, and we cannot guarantee uninterrupted availability.

The receptionist will not quote prices, give opinions on insurance coverage, or advise anyone to climb onto a roof. It may occasionally mishear a caller or misunderstand a request. Reviewing your calls and telling us what to change is part of how the service works.

Acceptable use

You may not use the service to make unsolicited marketing calls, to impersonate another business, or for any unlawful purpose. We may suspend the service if we believe it is being used this way.

SMS terms

These terms apply to the account text message programme operated by Livingstone Rentals LLC, doing business as Luke547. They apply in addition to everything else on this page.

What we send, and who sends it

Messages are sent by Luke547 to contractor clients who have given consent. We send setup and account messages while your service is being configured, service notices such as a change to phone routing or scheduled maintenance, and billing notices relating to your account. We do not send marketing or promotional text messages.

How you consent, and how you stop

You opt in by entering a mobile number on our setup form at luke547.com/start and ticking the consent box. The box is unticked by default and is not required: consent is not a condition of purchase. How consent is collected, and the exact wording you agree to, is set out on our SMS consent page.

You must be 18 years of age or older to receive text messages from us. Do not give us a mobile number, or consent to messages, if you are under 18. If we learn that a number belongs to someone under 18 we stop messaging it.

Reply STOP to any message to opt out. We stop sending immediately, and you receive one final message confirming that you have been unsubscribed and will get no further messages. That confirmation is the last message we send to that number unless you opt in again.

Reply HELP for help. You will receive a message directing you to toms@luke547.com, which is a monitored address and reaches a person. You can also email that address at any time without texting first.

Frequency, cost, and delivery

Message frequency varies, typically fewer than 10 messages per month, and depends on your account activity.

Message and data rates may apply. We do not charge you for messages. Any charge comes from your own mobile carrier under your own plan, and it is between you and them.

Carriers are not liable for delayed or undelivered messages. Delivery depends on mobile networks we do not control, and we cannot guarantee that any message will arrive, arrive on time, or arrive at all. Do not rely on a text message as the only notice of anything time critical.

Your number and your data

We do not share, sell, or provide your mobile phone number or SMS consent data to third parties or affiliates for marketing or promotional purposes. What we collect and how we handle it is set out in our Privacy Policy.

Your data

Call recordings, transcripts, and lead records generated for your business belong to you. We hold them to run the service and to review call quality. We handle them as described in our Privacy Policy. On request after cancellation, we will provide a copy of your lead records.

Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect or consequential losses, including lost business or lost profits.

Governing law

These terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules.

Changes

We may update these terms. If a change materially affects you, we will tell you before it takes effect. The date at the top shows when they last changed.
